Families serving overseas - university applications

This advice follows a recent case where a dependent based overseas with their serving parent was treated as an international student by a university admissions office, which led to the incorrect fees system being applied. This should not take place – any dependent accompanying their serving parent/s overseas should be treated as a UK resident.

The relevant regulation is Schedule 1 of The Education (Student Support) Regulations 2011, as amended by The Education (Student Fees, Awards and Support) Amendment (No 3) Regulations 2021.

Paras 4 and 5 of the amended Schedule state:
(4) For the purposes of this Schedule, a person (“A”) is to be treated as ordinarily resident in an area if A would have been so resident but for the fact that…
(a) A
(b) A’s spouse or civil partner
(c) A’s parent or,
(d) in the case of a dependent direct relative in the ascending line, A’s child or child’s spouse or civil partner,

is or was temporarily employed outside the area in question.

Temporary employment outside the area in question includes: ‘in the case of members of the regular naval, military or air forces of the Crown, any period which they serve outside the United Kingdom as members of such forces’

Defence Children Services Update - Overseas Educational Clearances during the Summer break

Overseas Educational Clearance during the Summer Break

MOD Assessment of Supportability Overseas (MASO)

DCS will continue to support where possible, Educational Clearances for overseas postings ove the Summer break. The usual requirements will remain and this includes the child’s current provision to complete the Education Overseas Supportability (EOS) Form. However, due to the summer holidays with UK schools being closed, this process may be delayed and Educational Clearances can only be issued once all the relevant information has been gathered.

Where a child is going directly to a MOD provided school overseas, the MOD provided school will support this process (please contact the school directly).

Where a child is going to an overseas location where no MOD provided school is available, the OES team will support this process. Please contact RC-DCS-HQ-OES@mod.gov.uk

When additional needs have been identified, e.g. Special Educational Needs, then the OES team and MOD provided schools may require additional information. This information is vital to allow the smooth continuation of children’s education as they move between schools and countries. Where further more complex needs have been identified, this may result in decisions around supportability needed to be made at a panel level. It is highly likely that these panels will only reconvene at the beginning of the autumn term.

Children’s education is of high importance and quality information about children’s needs are vital in allowing the smooth continuation of this. We thank you for your support.
